摘要
法的构成是法的最基本的范畴,是一切法学研究的起点。法是由"理"、"势"和"事"构成。"理"即法的本质、法的内在的实质构成,包括法的内容、法的价值性、法的真理性和法的规律性。"势"即法的形式、法的外在的形式特征,包括法的执行力、法的强制力、法的制度体系、法的观念和法的秩序。"事"即法的过程、法的事实构成,包括法的制度事实、法的实施过程与法的事实基础。
The composition of law is the most elementary category of law, any research concerning law starts from it. The purpose of this thesis is to put forward an opinion that law is composed of ＂theory＂, ＂form＂and ＂fact＂ which follows an introduction of various theories about the composition of law. ＂Theory＂ means the essence of law and the intrinsic essential substance of law; it includes the contents of law, the value of law, the truth of law and the rule of law. ＂Form＂ means the characteristics of extrinsic form of law; it includes the performance of law, the enforcement of law, the system of law, the concept of law and the order of law. ＂Fact＂ means the process of law and the facts composition of law; it includes the system facts of law, the process of performance of law and the facts foundation of law.
