摘要
《中华人民共和国侵权责任法》的实施使病案作为医疗诉讼中的书证被提升到更重要的地位。本文从法律的视角出发,基于病案在诉讼中的重要作用,探讨如何完善病案形成过程和管理,降低医疗机构在可能产生的医疗诉讼中败诉的风险。
With the implementation of ＂Tort Law of the People＇s Republic of China＂ ,Medical records,the documentary evidence of medical lawsuit,have been promoted to a more important position. On basis of the importance of medical records in lawsuit process,the article gave us a legal view to investigate how to improve the formation process and management of the medical records and reduce the probable risks of defeats of medical institutions in medical lawsuits.
