摘要
法律术语是法律语言的基础和核心,其在法律文本中的准确使用直接服务于立法技术的规范化、科学化目标的实现。基于原型范畴理论,以是否具有专门的法律意义和明确的法律概念指称功能为根本标准,本文将法律词汇分为本域术语和借域术语,进而对二者进行了更细致的二级和三级分类。这些细分的类别构成一个法律词汇原型范畴。
This paper studies on the legal terms of legislative texts in the context of the legislative standardization and scientific pursuit of legal language. This study adopts the prototype theory which stresses ＂specific legal meaning＂ and ＂the alleged function of the legal concept＂ as the fundamental principle, then classifies the legal terms into specific lexical items and the expressive function words, and conducted a more detailed classification. The classification results constitute a prototypical category of legal lexicon.
