论土地使用权出让制度与可持续发展战略 被引量:14

System of Transferring the Right to Use Land and Strategy of Sustained Growth

摘要 可持续发展已成为我国经济发展的基本战略,我国房地产业暴露出来的一些问题与这一基本战略的要求存在相当的差距。我国近年来房地产业已呈现出发展的非持续性态势,产生了一些令人关注的问题。土地使用权出让制度主要源于香港,其特殊的历史背景和经济法律环境造成这种制度在经济可持续发展问题上先天不足。这种制度在香港有其合理性,但在我国内地产生的后果却十分严重,必须及时解决,具体举措可以加强土地资源的物权法保护。 Abstract Nowadays,maintaining sustained growth has become the basic strategy of economic development in China.Problems in real estate industry in recent years,however,showed considerable gaps from requirement of this basic strategy.Signs of unsustainable growth have become evident,which gives rise to many problems of common concern.Our current system of transferring the right to use land originated in Hong Kong.Its premature nature caused by the specific historic background and economic legal environment becomes a problem,making it unable to meet the demand of sustained economic growth.This system can fit into the Hong Kong situation, but does not work well in the interior of China.Things have to be done to solve this problem.Here are some suggestions:Strengthen protection of land resources,perfect system of transferring the right to use land, and refer to related international regulations practiced elsewhere in the world.
