摘要
富勒围绕法律与道德的关系这一主题进行理论建构。他独辟蹊径,提出了颇具特色的法伦理思想。与实证主义法学比较,富勒法伦理思想具有许多重要特征,即:坚持应然与实然的一致性;坚持目的与手段的一致性;提出合法性原则人性前设的低限度要求;主张法律与道德的结合;主张"恶法非法"。
Lon.L.Fuller created the theory of the theme of the relations between the law and morality.He put forward the particular law theory with lone characteristic.Comparison to the factual law theory Fuller’s law theory is of multi-characteristics： that he is for the unification of the purpose and the means and ways;that the lower-limited requirement of human nature submitted based on the law principle;He fought for the combination of the law and morality;He insisted that the unlawful is nonsense.
