摘要
立功制度是我国特有的一项刑罚制度,其设立有一定的理论和现实依据。但在实践中大量出现的非正常立功现象促使我们重新审视立功制度的设立依据,并需对现制进行渐进式调整,进而最终取消我国刑法中的立功制度。
Meritorious service system is a unique penal system in China.Its establishment has some theoretical and practical basis.But in practice,large numbers of abnormal meritorious behavior prompted us to re-examine the basis of a system of meritorious service,and it is necessary to gradually adjust the current system and ultimately to abolish our system of the meritorious service in criminal law of our country.
