摘要
事实有据是行政登记行为合法要件之一,因此事后有证据证明存在伪"真实"事实的情况下,即使行政机关尽到了注意义务也应该认定登记行为违法。尽到注意义务并不是行政行为合法的要件,只是可能免责的条件。司法审查登记行为的事实基础和行政机关登记时审查事实基础的目的是不同的,司法审查的事实范围不受行政机关审查事实范围的约束。行政机关尽到审查义务和目前国家赔偿违法归责原则存在冲突,有关责任承担可借鉴国外做法逐步地完善。
Factual validity is one of the legal requirements for administrative register.Therefore,registration behaviors in which there are pseudo-factual circumstances,once evidenced by proofs afterwards,are to be identified as illegal even if the administrative registration authority has fulfilled its duty of care.Fulfilling the duty of care does not mean that relevant administrative behaviors would be legally justifiable,but rather it is a condition to be taken into consideration for possible exemption from liabilities.The mindset of judicial review of the factual basis of registration behaviors and that of the administrative registration authorities in their administrative review of the factual grounds their registration behaviors are different in that the factual scope of judicial review is not restricted by the factual scope of administrative review.However,the stipulation requiring administrative authorities to fulfill their review obligations contradicts the China's present principle of state compensation liability.Concerning the arrangement of responsibility assumption,overseas experience and practices can be used for reference in this regard,based on which to gradually improve that of ours.
