摘要
"治理"模式存在多元治理目标差异和权责边界模糊性等内在缺陷。由于权利的交叠性和扩张性,社会生活的复杂多变和法治的滞后性以及治理主体文化价值观念的差异,在治理过程中容易出现权利冲突;主体的多元和边界的模糊又使治理过程中主体责任难以明确,结果导致"治理失灵"。政府拥有比其它治理主体更大的公共性和能力,构建和完善政府主导的多元治理模式是走出"治理失灵"和构建和谐社会的有效途径。
＂Governance＂ model have the features of diversity of gerent and the fuzzy boundary in rights and responsibilities.Due to the expansion and overlap of the rights,complexity and ever changing of the civil society life,the lag of the legislation,and the differences in cultural values of gerent,the conflict is likely to break out in the course of governance.Because of the diversity of gerent and the fuzzy boundary in rights and responsibilities,it is difficult to distinguish accountability in the process of governance,which may cause ＂the failure of governance＂.This shows that the model of governance exists defects,which is hard to overcome by itself.At present,to build and improve the government led multi-governance model is an effective way to settle ＂the failure of governance＂.
