摘要
男女平等的思想自新中国成立以来就已深深根植于人们的头脑当中,但如何真正做到男女平等却是时至今日仍一直在探讨的问题。近一段时日以来,人们一直在探讨争论的"妻子是否可以查丈夫财产"问题,便是其中一个。对于妻子是否具有持证可查丈夫财产问题需要从更深层次去思考和分析,在它的背后隐藏着不同利益和权利的抗衡,其中隐含了隐私权与知情权之冲突、下位法与上位法之冲突、单位利益与公民权利之冲突等,需要从提高公民权利和加强国家立法的角度解决这一问题。
Since the establishment of new China,the idea that men and women are equal is deeply rooted into people＇s minds.However,how to achieve the status of equality of men and women is still an issue we have been always probing into.One of them is：in recent days,people are probing into the issue that ＂if wives can check husbands＇ property＂.With regard to the issue we need to think over and analyze from deeper levels.In the back of the issue,there are counter-balances of different interests and rights,among which there are conflicts of right of privacy and right to learn the truth,conflicts of higher-level laws and lower-level laws,conflicts of units＇ interests and civil rights,and so on.We need to solve this issue from the aspects of improving civil rights and strengthening national legislation.
