摘要
反思危机爆发之前的美国金融消费者保护,分散立法存在大量漏洞与空白,对消费者的倾斜保护意识不足;监管当局奉行金融效率至上的监管理念,对金融消费者的保护多口惠而实不至。本次金融危机深刻表明,保护金融消费者,不仅直接关涉金融消费者之微观利益,更关乎金融安全与稳定,应成为现代金融监管所秉持之首要基础价值。反观我国,金融监管保护金融消费者的目标往往让位于做大市场规模的目标,为整个金融市场安全埋下了隐患,急需予以矫正。
The reflections on the U.S.financial consumer protection before the crisis shows that there was a large number of loopholes and gaps in the scattered legislation,the awareness of tilt protection was inadequate;the regulatory authorities pursued the regulatory concept of supremacy of financial efficiency,and financial consumer protection was just wishful thinking which was really not to be done.The financial crisis shows that the protection of financial consumers not only directly concerns in the micro-finance consumer interests,but relates to financial security and stability,so the modern financial regulation should uphold financial consumer protection as the primary basis value.In China,the objective of consumer protection of financial supervision tends to give way to the objective of bigger size of the market,which bury hidden dangers to the security of the entire financial market,and need to be corrected.
