摘要
域外网络隐私权的保护有两种基本模式:一是以美国为代表的行业自律为主导的模式;一是以欧盟为代表的法律规制为主导的模式。两种保护模式各有特色,各有利弊。考虑到我国的实际情况,以网民为中心、以行业自律为辅助和以法律法规为保障的"三管齐下"综合保护模式可能是最佳选择。
There are two basic models abroad for the protection of the fight to Intemet privacy. One is represented by the USA which takes the self-discipline of Intemet industry as the lead ; the other is represented by EU which mainly uses laws and regulations to protect the fight to Intemet privacy. Both models have their own characteristics, and advantages and disadvantages. Taking China＇s actual conditions into consideration, the comprehensive protection mode of taking the netizens as the center and laws and regulations as the guarantee with the assistance of the self-discipline of the Intemet industry may be the best choice.
