摘要
为解决调解协议效力问题,突出调解程序在解决劳动纠纷中的作用,新制定的《劳动争议调解仲裁法》设置了劳动争议调解协议可向法院申请支付令等制度。但是,该法在劳动争议调解效力规定方面还存在一些问题,需要进一步完善。
In order to settle the validity of mediation agreement and emphasize the role of mediation system, the Law of the People's Republic of China on Mediation and Arbitratfon for Labor Disputes stipulates that labor disputes mediation agreement can apply to the basic people's court that has jurisdiction for an order of payment based on the mediation agreement. But the validity of the mediation agreement is imperfect and it needs to be improved.
