摘要
基础规范和承认规则是凯尔森和哈特法学理论的核心概念,它们是解释法律规范或规则效力的最终答案,是一个理智的假定,但它们本身是法律系统的实际有效性。基础规范和承认规则是联系事实与规范(规则)的纽结,理解它们是认识分析法学的关键。两者有相似性,也存在一些差异。
Basic norm and rule of recognition are core concepts in the law theory by Kelsen and Hart,which explain the ultimate answer to legal norms and rule effectiveness.And as a reasonable hypothesis,they themselves are the validity of the legal system.Basic norm and rule of recognition are a connection between fact and rule,and understanding them is the key to understanding analytical jurisprudence.They share some common features with certain differences.
