摘要
中国语境下的"政府雇员",是指在公务员体制以外,通过聘用合同受雇于国家机关,从事辅助性、临时性事务,由国家财政负担工资、社会保险的工作人员。理论上,"非公务员身份""非权力性""辅助性""临时性""弹性化"和"低薪制"是其制度的基本特征。为推进我国人事制度法制化进程,须借鉴域外行政和立法经验,立足本国国情,从立法依据、目的、原则、适用范围、编制和经费等方面进行探讨。
Government employees in China are the people who are not civil servants but employed in state or- gans by employment contract. They are engaged in auxiliary or temporary work whose salary and social insurance are provided by national finance. Theoretically, non - civil servant status, no power, doing complementary and temporary work, flexible management and low- legislative process of China' s personnel system, salary are the main characteristics of the system. To promote the we should learn extraterritorial administrative and legislative expe- rience while basing on the situation of China and conduct discussion on the legislative basis, objective, principle, applicable scope, authorized size and funds, etc.
