摘要
笔者和项目组其他成员主要调查了解了陕西省西安市、榆林市、咸阳市和商洛市及安康市所辖部分县区内的法院、检察院、公安机关等对家庭暴力的认知、干预职能、职责分工、工作机制、处理措施、取得的成绩和存在的问题及执法现状等情况,分析了陕西省家庭暴力产生的原因、类型、特点及危害后果,并提出完善相应的司法干预机制和相关立法的建议与对策,其中重点建议应切实提高公安、司法人员的综合素质和执法水平,加强相关法律、法规的学习,促进对法律保护人权这一基本精神的认识与理解,真正厘清和正确把握法律规制家庭暴力与维护家庭和谐的关系。同时急需制定与完善陕西省防治家庭暴力的统一的专门的地方性法规及司法干预的机制,包括有必要在陕西省基层法院选点尝试开展对家庭暴力受害者的司法保护措施,即设立维护家庭暴力受害者人身安全的保护裁定(民事保护令)制度。
The writer of this paper and other members of the program team mainly probed and fond out the cognition, meddling role, responsibility division, work system, disposal measures and their merits, of the court, prosecutor and public security organ of Xi＇ an, Ankang, Yulin, Xianyang and so on, when they deal with domestic violence. Presenting problems and legal implement situation, we analysis those causes, types, characteristics and harmful consequence, bring out corresponding judicial meddling system and legislation proposal as well as countermeasure. We especially propose that it be necessary to enhance the general quality and legal implement standard of public security and judicial personnel, strengthen the study of related law and regulation, promote the comprehend and cognition to the basic spirit which law protect on human fight, actually clear out and correctly grasp on the relationship be- tween regulated domestic violence and protected family relation by law. Simultaneously, it is also necessary to regulate and perfect local regulation and judicial meddling system of Shanxi province on preventing from domestic violence,including attempting to implement judicial protection measure on the victim of domestic violence in selected primary courts, that is, to establish protective judgment system of human safety aiming to protect the victim of domestic violence（civil protected-order）.
