摘要
科学的发展使得诉讼证明的科技含量越来越高,并日益冲击着我们的证据制度。测谎技术作为查明真相、揭发谎言的一项里程碑式的发明,对案件事实的证明发挥着重要的作用。但国内外理论界对测谎技术的应用、测谎结论的法律地位仍众说纷纭,莫衷一是。测谎技术在我国司法实践中已大量使用,但现行法律却未对其法律属性加以规范,这不仅使测谎结论的适用无法可依,也制约了测谎技术的进一步发展。
With the development of modern science and technology, scientific evidence has been widely used in judicial procedure with increasing impact on the evidence rules. Polygraph test is a milestone in human history of revealing truth, and plays an important role in fact detection and proof. But the application of polygraph and legal status of the conclusion are still under dispute. Although polygraph test has been widely used in China＇s judicial practice, the existing law does not regulate it. There are no norms on testing personnel as well as the admissibility rules. It leads to the disorder of polygraph application and holdback the advancement of the technology in judicial proceedings.
