摘要
刑法是保护环境的重要手段之一。在人类社会面临全球性的环境危机的情况下,世界各国的环境刑事立法方面出现了刑法调控范围扩大化、处罚严厉化、处罚方法多样化和以预防为主的趋势。为了治理日益恶化的生态环境,中国1997年修改刑法之后规定了重大环境污染事故罪。但是,由于立法价值的偏离,中国重大环境污染事故罪存在着一些缺陷,应借鉴世界环境刑法的立法经验,并结合中国环境治理的实际情况,对其进行必要的修改。
Criminal law is one of the most important measures to protect environment and its trend is the expansion of the scope,severity of the punishment,diversity of punishment and prevention-oriented.In order to control the deteriorating ecological environment,China prescribed the accident crime of great environmental pollution after amending criminal law in 1997.But there are some defects in the accident crime of great environmental pollution.We should carry out changes drawing on the experience of environmental criminal law legislation and combining with the actual situation of China.
