摘要
宋代版权问题的产生,是宋代社会政治、经济、文化、法制、科技、书籍生产等因素全面发展的产物。宋朝产生了中国古代书籍生产与传播中比较显著的版权观念及相对成型的版权保护法制规范。可以认为,宋朝是中国古代书籍著作者与生产者真正开始实现版权自觉的时代。宋代版权问题是宋代商品经济与雕版书籍业发展的必然产物。不了解宋代历史,就不可能对宋代版权问题作出科学合理的解释。宋朝的版权问题是历史地客观存在的。宋朝的版权保护只有在宋朝的历史背景上才有它的真实性及其意义。宋朝的"文治"政治总体上使其书籍生产的出版环境十分宽容,因而一直被称为中国古代书籍出版史上的"黄金时期"。虽然宋朝并未制定出专门的出版法,但是在宋朝的法律框架内,已经运用国家政权、法律以及民间协调的力量对诸如盗版等侵权行为实施治理。从政府到民间,关于版权保护的一般观念已经普遍产生。眉山程舍人宅出版书籍上的刊语"已申上司,不许覆板"即是一句典型的版权保护语言符号。总之,宋朝已经形成了从版权及版权保护观念、法律申诉、依法断案、判决与执行乃至民间协调等一系列的版权保护程序。
The appearance of questions on copyright in Song Dynasty was the product of all-round development on society,politics,economy,culture,law,technology,books production,as well as other factors in Song Dynasty,and the inevitable outcome of the commodity economy and the Diaoban book industry in Song Dynasty,in particular.The quite remarkable copyright idea in the production and dissemination of the China＇s ancient books and the relative formation copyright protection standard legal system appeared in Song Dynasty.We can say that the Song Dynasty is the age for the authors and producers of China＇s ancient books to begin to realize the copyright awareness truly.The copyright question existed historically and objectively in Song Dynasty.Only in the historical background of the Song Dynasty can the Song Dynasty＇s copyright protection have its authenticity and significance.The ＂WenZhi＂ politics in Song Dynasty gave its books production a striking tolerant publication environment in general,thus,the Song Dynasty has been known as ＂the golden time＂ in the China＇s ancient books publication history.Although the Song Dynasty didn＇t work out the special publication law,the government had already been exerting the state power,law and the folk coordinated strength as well to implement against the behavior of rights violation,such as the pirate,in the Song Dynasty＇s legal framework.The general idea on copyright protection had been widely produced,from the government to the folk.＂Yi Shen Shangsi,Bu Xu Fu Ban＂,the issue of language printed on the books published by Meishan Chengsheren Zhai,is a typical copyright protection verbal symbol.In conclusion,a series of copyright production procedures had already formed from the concept of copyright and copyright protection idea,legal appeals,setting a lawsuit according to law,the decision and execution to even folk coordination.
