摘要
无论是英美法系国家任命制下的法官,还是大陆法系国家的职业法官,其初衷都是以非民选的方式为基础,这却在一定程度上造成了其与"民主"之间的"紧张"关系。如何解决这一"紧张"关系,有效的途径即是从社会、民众的角度加以调整。对我国的法官职业建设而言,也应注意这个问题。
The nomination of judges is on the basis of non-publicly elected as the original intention, either the common law system＇ s nomination or the civil law system＇ s professional judge, howerer, it has resulted the ＂anxious＂ relation between the justice and democracy. The best way to resolve this ＂anxious＂ relation is the modification from perspective of society, and public peoele. For our country＇ s judge professionalism construction should also need to consider this problen.
