摘要
研究目的:对中国转型期土地权属纠纷进行系统分析并归纳其特点,提出相应的文化对策。研究方法:理论分析法,文献资料法。研究结果:在转型期的中国,土地权属纠纷案件呈现诉讼增多、司法取证困难、审结案件余波无法平息等情形,影响和谐社会的建设。对此现状,通过对其系统分析,笔者认为应在维护好民族文化的稳态延续前提下,借鉴各民族化解土地权属纠纷的经验与智慧,充分挖掘并发扬民族文化拥有的土地资源利用与维护的知识技能。研究结论:提出化解土地权属纠纷的文化对策,并与经济、管理、法律手段相结合,达到对土地资源进行有效维护和高效利用的目的。
The purpose of this paper is to provide cultural countermeasures for the disputes on the property rights of land in the transition period in China basing on a systemic analysis and a summarization on the characters. Methods used include theoretical analysis and documentation. The study finds that the disputes on property rights of land are increasing in the transition period; meanwhile the judicial evidences for the court are difficult to be collected. Furthermore, the spillover effect of the disputes still exists even after the judicial cases are closed. All of these do harms to the harmony of the society. In order to solve the problems, this paper points out that it is useful to explore and develop the knowledge and skill of using and preserving land resource referring to the various ethnic groups＇ experience and intelligence on solving land property disputes, however it should be under the premise of maintaining the steady continuity of the national culture. The paper is concluded with providing some cultural countermeasures for solving the land property disputes, which are further combined with economic, governance and legal measures in order to achieve the goal of effectively preserving and efficiently using the land resource.
