摘要
体育仲裁是我国《体育法》等体育法规确定的解决体育纠纷的基本方式,民间性是体育仲裁的基本属性。作为仲裁制度和体育制度的有机组成部分,体育仲裁制度的建立和完善需要从这两个制度获得理论和技术支撑,这两个制度本身的缺陷与失调会成为建立体育仲裁制度的障碍。民商事仲裁与行政仲裁的划分及不同立法模式,仲裁法实施中的行政化倾向以及现行行政主导型的竞技体育管理体制,均为民间性体育仲裁制度的建立设置了诸多障碍。体育仲裁制度的建立和实施需要这些基础制度的修改和完善。
Sports arbitration is the basic way to resolve the sport disputes determined by Sport Law in China. Non-governmental nature is the basic property of sports arbitration. As an integral part of the system of arbitration system and sport system, the establishment and improvement of sports arbitration system is required to obtain theory and technical support from the two systems. These shortcomings of the two systems and the imbalance will also become an obstacle to the establishment of the system of sports arbitration. The division of civil and commercial arbitration and administrative arbitration and different legislative models, the administration tendency in the operation of current arbitration law, and the existing administration-oriented sports management system are many obstacles to the establishment of non-governmental nature sports arbitration system. The establishment and implementation of sports arbitration needs these basic systems to be modified and improved.
