摘要
非物质文化遗产的法律保护是学界研究非物质文化遗产问题的热点之一。文章以非物质文化遗产概念和范围的界定为基础,明晰非物质文化遗产与传统知识、民间文学艺术的关系,进而探讨知识产权制度对非物质文化遗产保护的正当性。
The legitimacy of legal protection of intangible cultural heritage is one of the hot topics in the law circle. The paper, based on the concept and scope of intangible cultural heritage, clarifies the relationship among intangible cultural heritage, traditional knowledge and folk literature and art. It also explores the legitimacy of legal protection and ultimately confirms legitimacy of intellectual property system to the non-material cultural heritage.
