摘要
模糊论是认识论的进一步发展,法律中也存在着模糊性现象,法律中的模糊性主要包括法律规范的抽象性、法律规范涵义的模糊性、法律适用的不确定性和立法技术上的不规范性等。认识法律中的模糊性对于充分发挥模糊性在法律中的积极作用,避免消极作用具有重要意义。
Fuzzy theory is the further development of epistemology. There is also fuzzy situation in the law including the abstract legal norms, the fuzzy meaning of legal norms, the uncertainty of the application and the nonnormative technique of the legislation. It is of great significance to recognize the fuzzy of the law so as to give full play of the positive role of the fuzzy and avoid the negative effects.
