摘要
警察即时强制手段是警察机关在社会秩序管理中,为排除紧急危害状态,通过对相对人的人身、财产或住所施加突然的强制力所采取的手段,具有即时性和强制性等特点。目前,警察即时强制手段主要有对人身的强制手段和其他强制手段两大类二十种左右。由于法律制度的不完善,实践中存在着法律依据不足、一些保安处分性质的强制手段处境尴尬、假借刑事强制手段规避法律现象严重、缺乏对强制手段的类型化研究等问题。在借鉴域外经验的基础上,需要在法治视野下重新构建:建立完善的警察即时强制法律制度,制定统一的保安处分法,加强对强制手段的类型化研究。
The instant compulsory means of the police are such means that the police organ take,using the coercive force against the body property or residence of administrative counterpart to get rid of the harm in the management of the social security.They have the characteristics of being instant and compulsory.Now the instant compulsory means of the police have two categories,eg the means against the body and other means ,about twenty kinds.Due to the imperfect of the legal system ,there are several main problems in the practice as follows ：lack of legal basis ;some means like rehabilitative measures up a stump;evasion of law in the name of criminal compulsory means;lack of the study of typification.On the basis of drawing on the experience of overseas,some measures should be taken in the respective of law：building self-contained legal system on the the instant compulsory means of the police;enacting unitive legislation about rehabilitative measures ;strengthening the research of typification.
