摘要
农会组织是近期国内学术界关注的热点问题。从法律上讨论不仅要探讨其宪法基础,还要从行政法的角度对其进行法制化分析。在比较研究日本等国和我国台湾地区在农会法制方面的经验的基础上,引入大陆法系的公法人理论,对农会公法人进行制度建构。我国立法机关应当制定专门法律,如"农会法",为完善农会组织提供法律规范依据和法律技术支持。
Famer union is a hotspot of domestic academia in recent years.Legally,not only the constitutional foundation of famer union should be discussed,but also need to analyze it from a perspective of administrative law.On the basis of comparison research on the experience of handling legal issue related to farmer union in countries like Japan and areas like Taiwan,theory of public legal entity of continental law system was introduced into China and system of public legal entity of farmer union has been constructed.Chinese legislature should create special law,such as'Farmer Union Law'to provide standard legal foundation and technique support for perfecting the organization of farmer union.
