艺术品流转中的法律保护研究 被引量：3

摘要 近年来拍卖行滥用《拍卖法》"瑕疵免责声明条款"规避赝品责任。然而"瑕疵免责声明"必须建立在"诚实信用"基础上,否则无效。建议买受人在提起有关拍卖中赝品问题的诉讼时应以《合同法》相关条款为依据,法院判决时也应适用《合同法》相关条款。并建议制定《艺术品拍卖法》或修改《拍卖法》,对"瑕疵免责声明"加以限制,加重拍卖行责任:拍卖行作为销售合同一方,买受人拍到赝品后一定期限内可以要求退货。
