摘要
患者的自主决定权、家属的干涉权、医疗干涉权之间具有冲突的可能性。明确医疗干涉权的适用前提,从伦理及法律两方面考察其面临的现实困境,进行合理的制度构建才是化解纠纷促进医患关系和谐发展的有效途径。
Conflicts may occur between patients＇ independent decision right, family members＇ interference right, and medical interference right. This article clarifies the applicable premise of medical interference right and explores its realistic predicaments from the ethical and legal perspectives. Reasonable system construction is a good solution to medical disputes, promoting a harmonious development of physician - patient relationship.
