摘要
《劳动合同法》及其实施条例的颁布和实施在维护劳动者权益方面有了长足进步,但仍然存在全面性、明确性、操作性、合理性等四个方面的明显不足,需今后加以完善,以强化劳动者权益保护,构建新型劳动关系。
The Labor Contract Law of China and the Regulation on the Implementation of the Labor Contract Law has made considerable progress in protecting labor rights and interests,but there are still obvious shortcomings and limitations.This paper presents an analysis of its limitations from four aspects: comprehensiveness,clarity,feasibility and rationality and puts forwards some countermeasures.
