摘要
专利池的发展及专利联合所发挥出的巨大作用,是科学技术发展的重大进步,对相关产业的发展起到了积极的促进作用。然而专利权人利用所掌握的专利池的技术,滥用市场支配地位、价格歧视等专利行为又严重阻碍了相关产业的发展,因此,辩证认识专利池对科技发展的促进作用和对竞争的限制作用,借鉴美日等国的相关立法和实践,在保护专利权人正当权益的同时,规制专利池中的专利权滥用问题,已经成为我国专利权领域的当务之急。
The development of patent pool and patent union is a great advancement of technology,which promotes related industries.However,the patentee makes advantages of its right,such as the abuse of market power,price discrimination,which block the relative industries.It is an urgent matter of the moment to have a clear conception of its function on both sides,use foreign legislations and practices for reference,protect the interests of patentee and regulate the abuse of patent rights in patent pool in China.
