摘要
未成年人和成人一样在法律上具有独立性,但其身心特点决定了其罪错行为与成人的违法犯罪具有本质上的不同。出于特殊保护的需要,世界上大多数国家和地区都建立起了适合自己情况的处理罪错未成年人的独立处分体系。由于强烈的传统报应观念和少年保护理念研究的滞后,我国一直比照成人违法犯罪的处罚措施来处理未成年人的罪错。随着未成年人罪错情形日趋严峻,确立未成年人优先保护理念,建立适合我国国情和未成年人特点的罪错处分体系已势在必行。
Being equal to adults in law,minors differ from adults in physical and mental traits.That is why juvenile delinquencies and misdemeanors are basically not the same as the crimes committed by adults.For the sake of special protection,most of the countries and regions have set up their own independent penalty systems coping with juvenile delinquen-cies.Due to the traditional justice of a retaliatory kind and to the insufficiency of juvenile protection studies,the juvenile delinquencies and misdemeanors are always punished with the reference of the adults ' criminal penalties.With the increase of serious juvenile crimes,it is imperative to establish our own juvenile delinquency and misdemeanor penal-ty system.
