摘要
强调了网络资源受法律保护的同时,还应当充分重视作者、使用者和提供者之间的权利和义务平衡;指出了适度的产权保护有利于人类文明,而过度的"保护"则会阻碍社会进步。如何做到二者对立统一是产权法追求的基本价值之一。
It emphasizes the equilibrium of the right and the duty between author, users and suppliers while the network resources are protected. The suitable protection of property right is beneficial for human civilization, while undue protection obstructs its progress. How to keep the unity of the opposites is one of the basic worth pursued in the property right.
