摘要
劳动保障监察在保护劳动者合法权益和用人单位合法权益、维护劳动关系的和谐稳定与社会的和谐稳定方面发挥着重要作用。但在监察实务中,采取何种监察模式实现这一目的,其过程、结果和结局却可能大不相同。本文在分析目前一般劳动保障监察模式的不足和缺陷的同时,提出了一种以江苏为代表的、具有区域特色的和谐监察工作模式,并详细论述了该模式的基本框架内容,阐述了该模式的创新意义以及对其适用性的思考。
Labor security supervision plays a significant role in protecting legal rights of both employees and employers, and maintaining stable harmonious relations of employment and society. But in the practice of supervision, different models will produce different results and effects in the different processes. Based on an analysis of shortcomings and deficiencies in current common model of labor security supervision, this paper presents a harmonious model of labor security supervision, and elaborates the essential framework for this model with its regional features as represented by Jiangsu Province.
