摘要
职务犯罪是一个严重的社会问题,与公共权力的滥用紧密相关,从经济人的理性角度探讨职务犯罪的产生原因,提出其预防和惩治措施具有非常现实的意义。基于"寻租"理论和犯罪经济学成本收益理论,研究职务犯罪的内在机理,提出如下对策或建议:应增大犯罪的直接成本、机会成本和惩罚成本,控制或减少犯罪收益,提高破案率,从而最终预防和减少职务犯罪。
Job-related crime is a serious social problem, and it is closely related to the abuse of public power. From the rational perspective of the economic man, it is of great practical significance to discuss the cause of job-related crimes and put forward measures for its prevention and punishment. Based on the ＂rent-seeking＂ theory and theory of cost-benefit of economics and crime, the inherent mechanism of job-related crimes is studied, the following suggestions are raised： increase the direct costs ＇of crime, the cost of the opportunity and the cost of punishment to control or reduce crime;improve the detection rate, and ultimately, prevent and reduce job-related crimes.
