摘要
宪法的概念是宪法学研究的首要问题,传统的宪法概念已不适应社会发展的需要,但目前又没有形成新的主流学说。学者们众说纷纭,从不同角度对宪法的内涵和外延进行了探究,在一些主要问题上形成了争论。宪法概念反映了宪法的本质属性,应当形成一个在时间和空间上都具有普适性的宪法概念,也正是这个标准使得传统宪法三要素受到质疑。当然,宪法概念的得出绝非轻而易举,需要学者们综合运用各种研究方法不断地进行探索。
The constitution concept is the most important question in constitution research. The traditional constitution concept does not meet the needs of social development, but new mainstream theory has not been formed at present. Many scholars, who have wide divided opinions, do researches on the constitution＇s connotation and extension from different ang- les and standpoints, and have arguments in some subject matters. The constitution concept reflects the constitution＇s essential attribute. We should form a constitution concept which is generally suitable in the time and the space. It is this standard that exactly causes the three essential factors of traditional constitution to be suspected. Certainly, it is not easy to obtain the constitution concept. And it needs the scholars to apply all kinds of methods synthetically to carry on the research unceasingly.
