摘要
随着民族、宗教等矛盾引发一个国家内乱或内战现象的增多,国际社会拟对其进行干涉的需要和压力也不断增加。然而,人道军事干涉在适用国际人道法时还面临诸多困境:人道军事干涉的政治性特征无法满足国际人道法的"人道化"要求、人道军事干涉有违国际人道法之人道救援中立原则的情形、人道军事干涉的商业化特征使国际人道法的实施复杂化、现代战争的高科技特征使得人道军事干涉很难遵守国际人道法、国际人道法的严重滞后性使其对人道军事干涉的规范目标可能落空。
Since the end of the Cold War, with the ethnic, religious and other contradictions of a country leading to the phenomena of civil strifes or civil wars increased, the international community has increasing pressure to interfere in it, although, there is no clear legal basis for humanitarian military intervention in the current international law, this intervention has become inevitable, and the application of international humanitarian law is also getting inevitable. However, some dilemmas are faced when applicating of internatioual humanitarian law in humanitarian intervention, including the political, commercial, and high - tech features of humanitarian military intervention, the humanitarian interveution＇s abuse of international humanitarian law, the lag of the international humanitarian law and so on.
