摘要
根据"所有的物权变动原则上都应纳入物权法"之原则,地震产生不动产物权变动的法律效果。因地震引起的不动产物权变动有四类:地震导致物权的丧失;地震导致不动产的变更;地震导致不动产的取得;地震间接影响不动产变动。在我国现行立法中,因地震等自然灾害引起的不动产物权变动存在着现行法无法适用或无法类推适用的情形,需要有专门的规则加以规范,或补充立法。法律需要注意因地震引起的不动产物权变动的法律效果与不动产登记实务操作的衔接,并有必要重新审视地震等自然灾害对登记程序的影响。关于地震引起的不动产物权变动的法律效果,如需补充立法的,既可以通过将来民法典"总则"编加以规定,也可由物权法自行明确。
Based on a basic assumption that 'all types of title changes should be brought into the judge of Property Law,no matter whether it's caused by judicial actions,factual behaviors or natural disasters' ,the article discusses the legal effect of title changes to realty caused by the earthquake. Through the research of categorization,it summarizes the title changes to realty caused by the earthquake into four types. From the view of application of law,it discusses separately the issues of 'when do the title changes to realty caused by the earthquake take effect' and 'how to make it intimately connected to the practice of real estate registration' ; From the perspective of complementary legislation,it studies how the title changes led by natural disasters,including the earthquake,be reflected in the civil legislation.
