摘要
不纯正不作为犯是刑法学上的一个非常抽象的概念,比作为犯其犯罪故意的认识要素更为复杂。特别是在作为可能性的判断标准上,各种观点争论不止,文章拟在对以往观点分析的基础之上试图探究不纯正不作为犯故意认识要素之奥秘。
The Impure Omission is a merely abstract concept in criminal jurisprudence. Unlike the act,it＇ s element of the intention is especially complex. Particularly on the standard of judge on the possibility of the act, many kinds of viewpoint are extremely different, on the basement of all kinds of the viewpoints; the element of intention of the impure omission must be distin- guished.
