摘要
物权法作为民法典的一部分,其基本要求便是对权利人的权利进行平等保护。物权法首次将平等保护原则写入其中,是对《民法通则》第七十五条的深刻反思。必须改变传统民法对国家财产实行特殊保护的观念。公民合法取得的财产应当受到与对国家财产和集体财产同等的法律保护,使人民群众积累的财产能够受到切实的保障,这也是物权法引进这一原则的重要意义所在。鉴于此,有必要对这一原则的基本内容和科学内涵及应注意的问题作一些概括的分析。
The basic requirement of property law as part of the Civil Code is the equal right protection of right persons. Property law includes the principles of equal protection for the first time, which is a profound reflection of the 75th term in ＂General Principles of Civil Law＂. Traditional civil law must be changed on the concept of special protection of the state property. The legitimate property of citizens should have the same legal protection with the state property and collective property, so that the people＇s accumulated property can be protected. Therefore, it is necessary to analyzes and summarizes the basic content and the scientific connotation of the principles.
