摘要
实行过限是共同犯罪中一类独特的错误形态,当属刑法中错误论的范畴;实行过限问题关系到共同犯罪的认定及共犯的成立范围。在实行过限的场合,部分行为人完全有可能就过限行为成立新的共犯关系,有必要就前后两种不同的共犯之间的罪数问题作深入分析,并以此确认各行为人的刑事责任。
The surplus behavior is a class of unique error patterns of joint crimes which should belong to the theory of error in criminal law. The surplus behavior not merely related to the identification of joint crime but to establishment of the scope of an accomplice. In the occasion of surplus behavior, some actors may set up a new relationship of accomplice. It is necessary to study the relationship of the crimes before and after, and under the guidance of this, to confirm the actors＇ criminal responsibility.
