摘要
对德国民法到底应持何种态度,在当代中国学界出现了重大分歧。在此背景下,《德国民法典》的贡献与局限,成为一个需要思考的问题。德国债法现代化改革说明德国社会正在对《德国民法典》的局限进行超越,我国应从《德国民法典》中汲取营养,总结教益。
China academic circles have disagreement on what attitude to German civil law. In this context, the contribution and limitation of German Civil Code becomes a question needs to ponder. The modernization reform of German debt law explains that German society is going beyond the limitation of German Civil Code. We should absorb essentials and learn lessons from German Civil Code.
