摘要
《矿产资源法》修改时必须确定修改的方向。根据物权结构,矿产资源所有权和由所有权设立的矿产权,属于明确物之归属的静态物权;对明确归属的特定矿产进行开发利用的行为,是动态物权。归属物权的抽象性资产与其他物权的地位平等,由现有法律调整;动态物权是人与人之间的社会性权利,因强势控制"互用资源"时产生负外部性效果,必须进行管制。通过严格禁止下的市场准入制,事先防止抢占他人利益和给社会产生成本。因此应制订以公共利益为目的的《矿业管理法》。
The aims must be defined in the time of amending Mineral Resources Law.According to the structure of real rights,the property of mineral resources and mineral rights established on the basis of the property belong to static real rights which establish ownership;the action of exploiting mineral resources,which has established ownership,belong to dynamic real rights.The abstract assets of ownership real right and the right over the property of another have equivalent status,they are adjusted by existing laws;dynamic real right is an interpersonal social right,it must be restricted,because strongly possession of 'interoperability resources' will produce negative external effect.We can prevent to usurp others' profit and exert negative effect on the society by strict market access system.Therefore Mining Management Law should be made for public interests.
