摘要
婚内侵权损害赔偿是指在不解除婚姻关系的前提下,依法判决侵犯配偶合法权益的一方因其过错行为而给另一方造成的损害给予赔偿的法律制度。我国《婚姻法》对婚内侵权损害赔偿的规定有许多不足,为给婚姻关系的当事人提供一个更有效的法律救济途径,就需要建立婚内侵权损害赔偿的相关制度,这是保护配偶权及维护家庭稳定的需要。
