摘要
在日益激烈的高科技竞争背景下,专利权滥用的认定演变为不断更新的全球问题。WTO-TR IPS协议对专利滥用并没有明确认定范围,不同国家的做法不尽相同,而我国的相关立法尚属空白。只有从专利保护期滥用争议在全球范围、国内内外资企业范围、历史范围和我国市场整体利益范围上的主要特点,以及滥用认定中懈怠原则的基本法理层面上,透视滥用专利战的产生与存在现象,我们才可以对全球专利战产生相对客观理性的认识态度。面对全球化的专利战,应当有序提高专利注册标准、合理借鉴西方懈怠制度。通过有组织的强化专利法及其滥用认定规范,才能对专利权人利益予以合法保护,进而维护我国在技术市场开放及技术进出口方面的整体利益。
How to identify patent right comes to be a worldwide upgrading issue against the background of ever - increasing severe competition. WTO - TRIPS agreement fails to define a clear scope of patent abuse, and each country takes different measure, but we have not stipulated it up to now. We should analyze the abuse of patent protection period in several aspects, such as the scopes of world, home and foreign investment corporations, historical background and major characteristics of overall interests in our market, as well as basic nomological meaning of laches principle in abuse identification. Only examining the emergence and existence of patent abusing war through the above ways, could we hold an objective view towards global patent war. So we should improve orderly the registered standard for patents and draw experience from western laches principle. By strengthening patent laws orderly and its abuse identification standards, we can protect patentees＇ rights legally, thereby safeguarding our overall interests concerning opening - up technological market and import - and - export technology.
