摘要
公正和效率是两项难以兼顾的司法价值追求。认罪案件简化审程序在分流案件,节约司法资源上有其重要的作用,认罪案件简化审程序如何在提高诉讼效率的同时,实现公正是一个值得关注的问题。通过对认罪案件简化审程序中采用的证明标准和证据要求进行新的构思、设计,可以最大限度的体现认罪案件简化审程序的公正和效率。
Efficienoy and jnstice one the two judicative value pursues, and difficult to realize in the same time. The simplifying procedure of the cases play an important rde in distributing the cases and saving judicative reaources. We should pay attention not only to improve the lawsuit efficiency but also to relize the justice when we use the simplifying procedure of the cases those criminal admit guihes. The justice and efficiency can be extremely embodied by making a new conception and design the proof＇ s standards and requirments in the simplifying procedure of the cases thoes criminal admit guihies.
