摘要
本文以生物学上的进化论为理论工具,以春秋战国时期的刑法思想为考察对象,通过着重考察对后世有持续影响的儒、法两家关于刑法的思想体系及其演变过程,来探寻历史演变的规律。
With the theory of bidogieal biologicalls evolution as theoretical tools and ideology of criminal law in the Spring and Autumn Period as the inspection object, this article aims to explore the laws of historical change by studying the ideological system on criminal laws along with its evolutionary process in the Confucianism and Legalism which have a longlasting effect on later generations.
