摘要
目前,国际山区法和国外山区法获得了长足发展,山区可持续发展立法已经成为一个新的世界性趋势。采用文献分析方法和比较分析法,首先探讨了山区和山区法的基本内涵,然后考察罗马尼亚山区法的立法宗旨和目的,基本原则,山区的法律定义,山区管理及其机构设置,山区社会和经济的发展以及山区环境保护等内容;最后在对《罗马尼亚山区法》评价基础上,建议我国宜出台一部综合性法律《山区可持续发展促进法》,以使山区政策和法律良性互动发展,确保我国山区可持续发展。
Nowadays, the sustainable legislation of mountain has become a new and worldwide trend with the developing of International Mountain Law and Foreign Mountain Law. With the methods of the reference analysis and comparison analysis, we first probe the basic content of the mountain and the mountain law, and then we study the aims, fundamental principles, the legal definition of mountain, the mountain management and its institutional setting, the social and economical development of the mountain, the environmental protection of the mountain, etc. Finally, we base on the appraise of Romania Mountain law, suggesting that China should enact a comprehensive law--Mountain Law, so that we can make the mountain policy and legal developing well, and guarantee the sustainable development of Chinese mountain.
