摘要
鉴于未成年人犯罪主体的特殊性,对未成年人犯罪主体适用无期徒刑需具体问题具体分析;未成年人犯罪可以适用罚金刑;应修改累犯制度,一是延长累犯中的期限规定,二是注意适用从宽处罚规定,三是应设置前科消灭制度。
Due to the peculiarity of subjects of the juvenile crime, it depends on actual situations whether life imprisonment is sentenced or not. Fine penalty can be used for the juvenile crime. Recidivist system should be corrected in the following three respects, prolonging time regulation, appropriate use of lenient penalty and abandonment of criminal record.
