摘要
我国的志愿者服务快速发展,但志愿者服务立法尚不够健全。主要表现在:立法级别较低,缺乏统一的志愿者法律;志愿者法律的具体规定零乱;缺少协调志愿者服务的法律规定;志愿者权利保护制度比较粗陋;缺乏与突发事件有关的志愿者立法。为此,应尽快完善我国的志愿者立法,包括:提高立法级别,建立统一的志愿者法律;规范立法依据;理顺志愿服务中各方的法律关系;建立纠纷解决机制和志愿者的人身财产保护机制;把志愿者服务与社会保障制度挂钩等,尤其是要重视完善突发事件中志愿者服务的立法。
While Volunteer service in China now has developed rapidly, the present legislation involved is yet hard to meet the requirements of the development, with main problems as follows. The legislative level is rather low, as there isn＇t a unified law and the present regulations are rough and tumble; legal provision for coordination of the work is badly needed; systematic protection of volunteers＇ rights is rather careless; stipulation for unexpected events is inadequate. The legislation must be therefore improved including： to enhance the legal level, to establish a unified law; to standardize legislative principles; to straighten out the involved legal relations; to build a mechanism to settle disputes and to protect volunteers＇ lives and property; to incorporate volunteer services into social security system. Particular attention should be paid to the legislation for unexpected and emergent events.
