摘要
乡村社会的排斥、农民的司法恐惧,国家法与乡村地方性知识间的张力以及人治传统文化等阻力因素延滞了现代乡村法律秩序的建构进程。唯有增强农民的法律意识,提高农村基层组织和干部依法行政的能力,整治司法腐败以及提升国家法的普适性,才能推动乡村法制现代化愿景的实现。
For rural social exclu sion, farmers＇ fear.tension between state law and rural local knowledge, traditional cultural of rule, the construction process of modern law order in rural was delayed. Only by enhancing the legal awareness of the farmers, improving the administration ability according to law of rural grassroots organizations and cadres, eradicating judicial corruption and enhanceing the application of law, can we promote the vision of rural legal system modernization to achieve.
