摘要
通过分析和总结法的价值和体育法的价值,对《中华人民共和国体育法》进行分析,研究认为,《体育法》的核心价值应该是公平,而不是秩序。《体育法》将秩序视为核心价值,造成了《体育法》的内在价值如公平、自由等价值的缺失;而《体育法》对公民个人体育权利的忽视,权利义务条款的比例失衡等问题则是《体育法》内在价值缺失的体现。
On the base of objective analysis of Sports Law of The People＇s Republic of China, this paper indicates that the core value of Sports Law of The People＇s Republic of China should be not order but equity by analyzing and summarizing value of law and sports law. Sports Law of The People＇s Republic of China looks order as its core value, which leads that Sports Law of The People＇s Republic of China is an evident lack of the internal value, such as equity, liberty, and justice. The questions of ignorance for individual sports rights, quantitative imbalance of sports and duty clause in Sports Law of The People＇ s Republic of China is no other than concrete embodiment of the internal value of Sports Law of The People＇s Republic of China.
